Cookies and tracking
We use cookies and similar technologies to run the store, remember your cart and preferences, measure how the site is used, and deliver and measure advertising.
Tools currently used on our site include Shopify (store, cart and checkout), Google Analytics, the Meta Pixel, Microsoft Clarity (session analytics), and Klaviyo (email marketing and on-site forms). For details of cookies used by our Shopify platform, see shopify.com/legal/cookies.
Most browsers accept cookies by default. You can set your browser to block or remove cookies, but parts of the site may stop working properly if you do.
Who we disclose your information to
We do not sell your personal information for money.
We disclose personal information to:
- Shopify, which hosts our store and processes orders and checkout on our behalf.
- Payment processors, to take and verify payment.
- Shipping and fulfilment providers, such as Australia Post and courier and freight partners, so we can deliver your order or return your repaired bat.
- Email and SMS marketing providers, such as Klaviyo, so we can send you the communications you have signed up for.
- Advertising and analytics providers, such as Meta and Google, so we can run and measure our advertising. In some jurisdictions this may be treated as "sharing" personal information for targeted advertising.
- Apps and service providers that support our store, including reviews, loyalty, customer support, accounting and IT providers.
- Professional advisers, insurers and regulators, where required.
- A purchaser or successor, if the business is sold, merged or restructured.
- Law enforcement or government bodies, where we are required or authorised by law, or to protect our rights or the rights of others.
Overseas disclosure
Some of our service providers are located overseas or store data overseas, including in the United States, Canada, the United Kingdom and the European Union. This includes Shopify, Klaviyo, Google, Meta and Microsoft. By using our services you consent to your personal information being disclosed to and stored in these countries. We take reasonable steps to ensure our providers handle your information appropriately.
If we transfer personal information out of the UK or EEA, we rely on recognised transfer mechanisms such as Standard Contractual Clauses, or an adequacy decision, where required.
Security and retention
We take reasonable steps to protect your personal information from misuse, loss, and unauthorised access, modification or disclosure. Our store runs on Shopify, and payment information is encrypted in transit. No system is completely secure, and we cannot guarantee absolute security. Please do not send us sensitive information over insecure channels.
We keep your personal information for as long as we need it to provide our services, manage warranties and repairs, meet our legal and tax obligations, resolve disputes and enforce our agreements. When it is no longer needed, we take reasonable steps to delete or de-identify it.
Your rights and choices
- Access. You can ask for a copy of the personal information we hold about you.
- Correction. You can ask us to correct information that is inaccurate, out of date or incomplete.
- Deletion. You can ask us to delete your personal information, subject to any legal or business records we are required to keep.
- Marketing opt-out. You can unsubscribe from marketing emails using the link at the bottom of any email, reply STOP to marketing SMS, or email us. We may still contact you about your orders and repairs.
- Advertising opt-out. Depending on where you live, you may have the right to opt out of the "sale" or "sharing" of your personal information, or its use for targeted advertising. You can contact us to do this, and you can also manage ad preferences directly with Meta and Google. If you visit our site with a Global Privacy Control signal enabled, we will treat this as an opt-out request where applicable.
- Portability, restriction and withdrawal of consent. Depending on where you live, you may have additional rights, such as receiving a portable copy of your data, asking us to restrict processing, or withdrawing consent where we rely on it.
To exercise any of these rights, email josh@jpgavan.com. We may need to verify your identity before we act on your request. We will respond within a reasonable time, and within the timeframes required by law. We will not treat you unfairly for exercising your rights.
Complaints
If you are unhappy with how we have handled your personal information, contact us first at josh@jpgavan.com and we will do our best to resolve it.
If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au. If you are outside Australia, you may be able to complain to your local data protection authority.
Children
Our services are not directed at children under 16, and we do not knowingly collect personal information from them. We understand that parents and guardians often buy gear for junior cricketers, and in that case we deal with the parent or guardian as the customer. If you believe a child has given us their personal information, contact us and we will delete it.
Third party websites
Our site links to other websites and platforms, including social media. We are not responsible for their content, privacy practices or security. Please read their privacy policies before giving them your information.
Reviews and public content
If you post a review or other content in a public area of our site or our social media, it will be visible to others. We cannot control how others use information you choose to make public.
Changes to this policy
We may update this policy from time to time to reflect changes in our practices or in the law. We will post the updated version on this page and change the "Last updated" date above.
